Determination of priority of conflicting claims to collateral
Open in Lexace · Ask the AI about this section
1. NRS 104.9101 to 104.9709 , inclusive, determine the
priority of conflicting claims to collateral. However, if the relative
priorities of the parties were fixed before July 1, 2001, the provisions of
article 9 which were in effect before July 1, 2001, determine priority.
2. For purposes of subsection 1 of NRS 104.9322 , the priority of a security
interest that becomes enforceable under NRS
104.9203 dates from July 1, 2001, if the security interest is perfected
under this article as amended by the filing of a financing statement before
July 1, 2001, which would not have been effective to perfect the security
interest under the provisions of article 9 which were in effect before that
date. This subsection does not apply to conflicting security interests each of
which is perfected by the filing of such a financing statement.
