Duty To Prosecute

80-4-426 . Duty to prosecute. (1) A county attorney who has appropriate jurisdiction and to whom any violation is reported shall cause appropriate proceedings to be instituted and prosecute without delay in a court of competent jurisdiction. (2) In addition to or exclusive of the remedy in subsection (1), the department may seek a civil penalty for any violation of this part.
