33-15-338 . Powers of commissioner. (1) At the commissioner's discretion, the commissioner may extend any dates under 33-15-333 through 33-15-340 . (2) The commissioner has sole authority to enforce the provisions of 33-15-333 through 33-15-340 or to seek remedies for its violation. (3) The commissioner may authorize a lower score than the Flesch reading ease score required in 33-15-337 when, in the commissioner's discretion, a lower score: (a) will provide a more accurate reflection of the readability of a policy; (b) is warranted by the nature of a particular policy or type or class of policy; or (c) is caused by certain policy language that is drafted to conform to the requirements of any state law, regulation, or agency interpretation.
