Actions And Special Proceedings Defined

27-1-102 . Actions and special proceedings defined. (1) These remedies are divided into two classes: (a) actions; and (b) special proceedings. (2) An action is an ordinary proceeding in a court of justice by which one party prosecutes another for the enforcement or protection of a right, the redress or prevention of a wrong, or the punishment of a public offense. Every other remedy is a special proceeding.
