20-3-202 . Term, oath, and vacancy. (1) The county superintendent shall hold office for a term of 4 years. The county superintendent shall: (a) take the oath of office on or before the last business day of December following the superintendent's election; (b) assume office at 12:01 a.m. on January 1 following the superintendent's election; and (c) hold the office until a successor has been elected and qualified. (2) Any person elected as the county superintendent shall give an official bond, as required by law. (3) If the office of county superintendent becomes vacant, the board of county commissioners shall appoint a replacement to fill the vacancy. The replacement shall serve until the next general election, when a person must be elected to serve the remainder of the initial term, if there is any remaining term.
