1. The department may destroy, or, at its discretion, cause to be treated with pesticides, volunteer or other noncommercial cotton and to establish procedures for the purchase and destruction of commercial cotton in eradication zones when the department deems such action necessary to effectuate the purposes of sections 263.500 to 263.537 . 2. No payment shall be made by the department to the owner or lessee for the destruction or injury of any cotton which was planted in an eradication zone after publication of notice as provided in sections 263.500 to 263.537 , or was otherwise handled in violation of sections 263.500 to 263.537 , or the regulations adopted pursuant to sections 263.500 to 263.537 . 3. The department shall pay for losses resulting from the destruction of cotton which was planted in such zones prior to promulgation of such notice.
