General permit application fees

(1) Each application for a surface mining permit and for coverage under a general permit shall be accompanied by an application fee in accordance with a published fee schedule adopted by the commission. The application fee shall not be less than One Hundred Dollars ($100.00) plus Ten Dollars ($10.00) per acre included in the application. The total application fee shall not exceed Five Hundred Dollars ($500.00). The commission, in considering regulations on the fee schedule, shall recognize the difference in the various materials, taking into consideration the commercial value of the material and the nature and size of operation necessary to extract it. (2) All state agencies, political subdivisions of the state, and local governing bodies shall be exempt from all fees required by this chapter. (3) Upon submission of the certificate of compliance required under Section 53-7-21 , each operator shall pay a fee of Fifty Dollars ($50.00).
