Federal preemption

(1) Nothing in this act is to be construed or applied to be less restrictive than federal law for a person or entity regulated by this act. (2) Nothing in this act is to be construed or applied to be in conflict with any of the following: (a) Applicable federal law and related regulations. (b) Other laws of this state if the state law is compatible with applicable federal law. (3) Limited distribution of a drug required under 21 USC 355-1 is not to be construed as a violation of this act. Added by Laws, 2024, ch. 319, HB 728,§ 6, eff. 7/1/2024.
