(1) A notarial officer may refuse to perform a notarial act if the officer knows or suspects the transaction is illegal, false or deceptive, or if the officer is not satisfied that: (a) The individual executing the record is competent; (b) The individual executing the record has the capacity to execute the record; (c) The individual's signature is knowingly and voluntarily made; or (d) The notarial act is in compliance with this chapter or with rules issued by the Secretary of State to implement this chapter. (2) A notarial officer may refuse to perform a notarial act unless refusal is prohibited by any law other than this chapter.
