(a) Members of the judges retirement plan are members of either the tier I or tier II program. (b) A tier I program judge is a person who was first appointed or elected as a judge before July 1, 2013, who was not eligible for the tier II program because the judge had five or more years of allowable service on or before December 30, 2013, or did not elect that program. (c) A tier II program judge is a person who: (1) was first appointed or elected as a judge after June 30, 2013; or (2) was first appointed or elected as a judge before July 1, 2013, had less than five years of allowable service on or before December 30, 2013, and made an election under Laws 2013, chapter 111, article 14, section 14, to be in the tier II program.
