MINIMUM SPENDING LEVEL.

A county or Tribal Nation receiving a subsidy under section 401.10 must not reduce its level of spending on probation services to lower than what is reimbursed by the community supervision formula under section 401.10, subdivision 1 .
If a county or Tribal Nation is unable to expend the full amount of the subsidy to which it would be entitled in the first year of a biennium, the commissioner must:
(1) retain the surplus; and
(2) disburse the surplus in the second year of the biennium if the county or Tribal Nation can demonstrate a need for and ability to expend the surplus.
