A notarial officer may perform a notarial act authorized by sections 358.51 to 358.76 , 359.04 , and other law. A notarial officer may not perform a notarial act with respect to a record to which the officer or the officer's spouse is a party, or in which either of them has a direct beneficial interest. A notarial act performed in violation of this subdivision is voidable.
