A public cemetery association which owns land that is or may be no longer used for the burial of the dead may exercise any or all of the following powers: (1) to institute and prosecute to final judgment an action to determine adverse claims to the land in accordance with the laws relating to actions to determine adverse claims; (2) to sell and convey the land; or (3) to transfer and assign any funds or other property it may possess to another public cemetery association serving the same community in the burial of the dead. None of these powers shall be exercised as long as any dead remain buried in the cemetery.
