Sec. 7701. Any party to a judgment rendered by a justice of the peace, conceiving himself aggrieved thereby, may appeal therefrom to the circuit court for the county where the same was rendered, in the following cases: (1) Where final judgment was rendered on an issue of law joined between the parties; (2) Where final judgment was rendered on an issue of fact joined between the parties; (3) Where the defendant did not appear and plead, and final judgment was rendered for the plaintiff on the merits of his claim; (4) Where a judgment of nonsuit has been rendered.
