Sec. 3. (1) Except as otherwise provided in this section, if a county board of commissioners establishes a farmers market or flea market pursuant to section 1, the county board of commissioners shall have control of the farmers market or flea market and may issue regulations for the use and operation of the farmers market or flea market. (2) If a county board of commissioners of a county that has adopted an optional unified form of county government under 1973 PA 139, MCL 45.551 to 45.573, establishes a farmers market or flea market pursuant to section 1, the county executive or county manager of that county shall have control of the farmers market or flea market and may issue regulations for the use and operation of the farmers market or flea market. (3) If a county board of commissioners of a county that has adopted a charter under 1966 PA 293, MCL 45.501 to 45.521, establishes a farmers market or flea market pursuant to section 1, the county executive or chief administrative officer of that county shall have control of the farmers market or flea market and may issue regulations for the use and operation of the farmers market or flea market.
