Sec. 16. (1) Except as provided in subsection (2), a person who violates or aids in the violation of this act, is guilty of a misdemeanor. (2) A member of the commission who intentionally violates section 5(2) shall be subject to the penalties prescribed in Act No. 267 of the Public Acts of 1976. (3) A prosecution under this act may be instituted in a county in this state in which the violation was committed, or in which a defendant resides or has a principal place of business.
