(a) Except as provided under subsection (d) of this section, the Board shall commence disciplinary proceedings under § 9-2426 of this subtitle on receipt of a complaint submitted to the Board against an applicant or a licensee. (b) (1) A complaint shall state specifically the facts on which the complaint is based. (2) If the complaint is made by any person other than a member of the Board, the complaint shall be made under oath by the person who submits the complaint. (c) (1) If the Board finds that a complaint alleges facts that are adequate grounds for action under § 9-2426 of this subtitle, the Board shall act on the complaint in accordance with § 9-2428 of this subtitle. (2) If the Board does not make a finding under paragraph (1) of this subsection, the Board shall dismiss the complaint. (d) (1) The Board may use a restorative justice program in lieu of taking final action on a complaint under § 9-2426 of this subtitle. (2) The Board shall adopt regulations for the use of restorative justice programs under this subsection.
