(a) The Archives may allow a unit of local government or its designee to have custody of an original local record if the unit or designee: (1) demonstrates that the unit or designee will preserve the record adequately; and (2) deposits with the Archives or permits the Archives to make a security microform copy of the record. (b) The Archives may not destroy a local record unless the Archives: (1) offers the record to the appropriate local government or its designee; and (2) the government or designee declines to accept the record.
