(a) To inspect excavation work for the Commissioner, the Commissioner may deputize an individual who: (1) is employed by a county, a municipal corporation, or the Washington Suburban Sanitary Commission or other similar authority; (2) has the approval of the chief of the unit for which the employee works; and (3) has attended a training course that the Division of Labor and Industry conducts and, on completion of the course, has passed an examination. (b) An individual deputized under subsection (a) of this section: (1) may inspect excavation work only in the county, municipal corporation, or other jurisdiction of any other authority that employs the individual; (2) has the authority of a safety inspector of the Division of Labor and Industry; and (3) shall report to the Commissioner on each action related to an inspection under this section, on a form that the Commissioner provides.
