(a) Unless the Board agrees to accept the surrender of the license: (1) A licensed direct-entry midwife may not surrender a license; and (2) A license may not lapse by operation of law while the licensee is under investigation or while charges are pending against the licensee. (b) The Board may set conditions on an agreement with the licensed direct- entry midwife under investigation or against whom charges are pending to accept surrender of the license.
