(a) In addition to the duties set forth elsewhere in this subtitle, the Commission: (1) Shall adopt regulations specifying the Comprehensive Standard Health Benefit Plan to apply under Title 15, Subtitle 12 of the Insurance Article; and (2) On or before March 1, 2008, in consultation with the Department, shall propose regulations to: (i) Specify the components of wellness benefits, offered under Title 15, Subtitle 12 of the Insurance Article, that include incentives or differential cost-sharing for employees based on their participation in wellness activities; and (ii) Require small employers receiving a subsidy of small employer health benefit plan premium contributions under Title 15, Subtitle 12A of the Insurance Article to agree to purchase a wellness benefit. (b) In carrying out its duties under this section, the Commission shall comply with the provisions of § 15-1207 and Title 15, Subtitle 12A of the Insurance Article.
