(a) An applicant for a sewage sludge utilization permit shall: (1) Submit an application to the Department on the form that the Department requires; (2) Certify by signature the truth and accuracy of the completed application; (3) Pay the application fee set by the Department to cover the cost of processing the application; (4) Obtain the written consent of the owner of the land where the sewage sludge will be applied, including an agreement that the owner will not violate the permit; and (5) Agree to permit or secure access to the sewage sludge utilization site for the purpose of any inspection permitted under § 9-243 of this subtitle. (b) Before a sewage sludge utilization permit is issued, the applicant for the permit shall: (1) File with the Department acceptable evidence of a bond or other security that the Department requires under § 9-240 of this subtitle; and (2) Satisfy every other requirement of this Part III of this subtitle.
