The Department may deny an application for a permit for a sanitary landfill system to any nongovernmental person if: (1) The owner of the land, the operator, or the applicant has violated: (i) Any law of this State or any other state concerning sanitary landfills; or (ii) Any regulation or permit condition of this State or any other state concerning sanitary landfills; or (2) The Department finds that operation of the sanitary landfill system would harm public health or the environment.
