(a) At least 21 calendar days before the public hearing, the governing body
of the county shall publish notice of the public hearing in a newspaper of general
circulation within the geographic area of the proposed district.
(b) The formation steering committee seeking to establish a district shall
send notice of the public hearing and a summary of the application to each owner of
nonexempt property and to the extent reasonably ascertainable, each commercial
tenant of nonexempt property within the proposed district by the earlier of:
(1) at least 90 days before the public hearing; or
(2) when owners of at least 20% of the total number of parcels of
nonexempt property express the intent to establish a district.

(c) Before the public hearing, the application shall be made available for
review during normal business hours in at least one location in the proposed district.
(d) Within 10 calendar days after the public hearing, if the governing body
of the county determines, in the sole discretion of the governing body, that the needs
of the district meet a purpose of this subtitle, the governing body may authorize the
district in accordance with § 12-1004 of this subtitle.
