(a) Subject to subsection (b) of this section, a qualified organization may conduct a benefit performance to which the public is invited or admitted with or without charge. (b) The net proceeds of the benefit performance: (1) shall benefit the qualified organization; (2) shall be used for the purposes of the qualified organization; and (3) may not benefit the private gain of a member of the qualified organization.
