(a) An appraisal management company may not: (1) knowingly fail to separate and disclose any fees charged to a client by the appraisal management company for the completion of an appraisal by an appraiser from the fees charged to a lender, client, or any other person by an appraisal management company for providing appraisal management services; or (2) knowingly prohibit an appraiser from recording the fee that the appraiser was paid by the appraisal management company for the provision of real estate services within the appraisal report that is submitted by the appraiser to the appraisal management company. (b) The Commission may not bring disciplinary action under § 16-702.2 of this title or recommend criminal sanctions under § 16-706 of this title based solely on subsection (a) of this section.
