(a) The Department may issue a permit to an applicant that satisfies the requirements of this subtitle. (b) The Department may not issue a permit to an applicant if the Department determines that an applicant cannot utilize food processing residuals without: (1) Causing undue risk to: (i) The environment; or (ii) Public health, safety, or welfare; or (2) Otherwise violating this subtitle.
