(a) The Secretary shall sample, inspect, test, and make analyses of any
commercial fertilizer and soil conditioner distributed in the State at any time and
place and to an extent the Secretary considers necessary to assure compliance with
the provisions of this subtitle.
(b) The Secretary shall adopt the methods of sampling and analysis from
sources, such as the journal of the Association of Official Analytical Chemists, or
methods that insure representative sampling and accurate examination.
(c) In determining for administrative purposes whether a commercial
fertilizer or soil conditioner is deficient in any component, the Secretary shall be
guided solely by the official sample obtained and analyzed as provided by this
subtitle.
(d) The Secretary may enter any public or private premises, including any
transportation vehicle, during regular business hours, to obtain access to commercial
fertilizer or soil conditioners or to records relating to their distribution.
