Notwithstanding any penalty provided by the provisions of this article, any
person who violates the provisions of § 4-123 of this subtitle is guilty of a
misdemeanor and, on conviction, is subject to imprisonment not exceeding six
months, or a fine not exceeding $3,000, or both. If the violation is committed after the
first conviction becomes final, the person is subject to imprisonment not exceeding
one year, or a fine not exceeding $5,000, or both. If the violation is committed after
the second conviction becomes final, the person is subject to imprisonment not
exceeding two years, or a fine not exceeding $10,000, or both. The court may impose
costs in its discretion.
