(a) This section applies to a Class 7 micro-brewery license in the county. (b) Notwithstanding § 2-209(b) of this article, the license may be issued only to the holder of: (1) a Class B beer, wine, and liquor (on-sale) license that is issued for use on the premises of a restaurant located in the county; or (2) a Class D alcoholic beverages license that is issued for use on the premises of the existing Class D license located in the county. (c) The Executive Director may not issue a license for premises on property that has been leased unless the landlord of the property presents to the Executive Director a receipt or certificate showing that there are no unpaid taxes due to the State, a county, or any local government from the landlord or any entity in which the landlord has a direct or indirect interest that: (1) is proprietary; or (2) has been obtained by a loan, mortgage, or lien, or in any other manner. (d) Notwithstanding § 2-209(g) of this article, for the holder of a Class D license in the county the hours and days for retail sales under the Class 7 micro- brewery license are those established for a Class D license in the county.
