(a) (1) Before a Class B license of any type may be issued, the applicant
shall attest in a sworn statement that gross receipts from food sales in the restaurant
will be more than the gross receipts from the sale of alcoholic beverages.
(2) If the license holder fails to maintain more gross receipts from the
sale of food than gross receipts from the sale of alcoholic beverages for a 6-month
period, the Board may revoke the license.
(b) (1) Subject to paragraph (2) of this subsection, a license holder of a
Class B license of any type shall file with the Board a sworn statement that the gross
receipts from food sales in the restaurant for the 6-month period immediately before
the filing of the report are more than the gross receipts from the sale of alcoholic
beverages.
(2) The Board may require a license holder to provide:
(i) the sworn statement required under paragraph (1) of this
subsection at least biannually, on dates to be set by the Board; and

(ii) supporting data to establish that the requirements of
paragraph (1) of this subsection have been met.
