(a) The license holder or an individual designated by the license holder who is employed in a supervisory capacity shall: (1) be certified by an approved alcohol awareness program; and (2) be present on the licensed premises at all times when alcoholic beverages may be sold. (b) A license holder who violates this section is subject to: (1) for a first offense, a $250 fine; (2) for a second offense, a $500 fine; and (3) for each subsequent offense, a fine not exceeding $1,000 or a suspension or revocation of the license, or both.
