(a) (1) If a person is charged with violating § 25-2708 of this title or with
selling or providing alcoholic beverages to an individual who is under the age of 21
years or visibly under the influence of alcoholic beverages, in violation of § 6-304 or
§ 6-307 of this article, a search warrant to be directed by the chief of police shall be
issued for the building or vehicle in which the violation allegedly occurred.
(2) A search warrant under this section may be issued by:
(i) the District Court on request of a person who charges
before the District Court that a violation has occurred; or
(ii) the circuit court, on request of a grand jury.
(3) If a violation is found, the chief of police shall keep as evidence:
(i) all liquor found in quantities and under conditions to
indicate that it is kept for barter, sale, or gift to an individual under the age of 21
years;
(ii) the materials and instrumentalities for manufacturing,
dispensing, transporting, or otherwise disposing of the liquor; and

(iii) the paraphernalia of a barroom or saloon.
(b) (1) The chief of police shall report the facts of the violation in writing
to the State's Attorney for the county.
(2) Any alcoholic beverages or the materials and instrumentalities
for manufacturing, transporting, dispensing, or otherwise disposing of alcoholic
beverages or the paraphernalia of a barroom or saloon is prima facie evidence of the
violation of § 25-2708 of this subtitle or § 6-304, § 6-307, or § 6-309 of this article.
