(a) The Board may issue a wine license privilege. (b) To qualify for the privilege, an applicant shall be a holder of a Class B (on-sale) beer and wine license or Class B beer, wine, and liquor license for use on a premises that qualifies as a restaurant under § 24-902 of this title. (c) (1) The privilege authorizes the holder to sell wine by the bottle for off-premises consumption without the cost of the wine counting as a part of the average daily receipts of the business required to meet the minimum 60% food sales requirement under § 24-902 of this title. (2) The privilege is not a separate class of license but is part of the existing Class B (on-sale) beer and wine license or Class B beer, wine, and liquor license of the holder of the privilege. (d) The annual fee is $100.
