(a) (1) In addition to the revocation and suspension procedures provided
under § 4-603 of this article, the Board may immediately suspend a license if it is
alleged by a person specified under paragraph (2) of this subsection that the license
holder has sold or provided alcoholic beverages to an individual under the age of 21
years with such frequency and during such a limited time so as to demonstrate a
willful failure to comply with § 6-304 of this article.
(2) An allegation under paragraph (1) of this subsection may be made
by:
(i) the Comptroller or an agent or employee of the
Comptroller;
(ii) the Executive Director or an agent or employee of the
Executive Director;
(iii) the Board or an agent or employee of the Board; or
(iv) a peace officer.
(b) A suspension under this section may not exceed 7 days.
(c) If a license is suspended under this section, the Board shall:
(1) hold a hearing on the matter within 7 days after the suspension
begins; and
(2) give notice to the license holder at least 2 days before the hearing.
(d) If the Board fails to provide the license holder with notice of a hearing
before the end of the fifth day after a suspension begins:
(1) the suspension shall end; and
(2) the license holder shall be allowed to resume the sale of alcoholic
beverages on the next day allowed under the license.
(e) This section does not prevent a license holder whose license is suspended
under this section from seeking an injunction or other appropriate relief.
