Powers and duties of department

1. Powers. In addition to powers conferred by any other provision of law, the department may:
A. Without notice, and at any time during regular hours of operation, enter the offices, facilities or
other places of business of slot machine operators, casino operators, slot machine distributors, table
game distributors and gambling services vendors to conduct administrative inspections to
determine compliance with this chapter and rules adopted under this chapter; and [IB 2009, c. 2,

B. Request the director to disable any slot machine or table game if the department has a reasonable
articulable suspicion that the slot machine or table game is being operated in violation of this
chapter or of any rule adopted under this chapter. [IB 2009, c. 2, §27 (AMD).]

2. Duties. The department shall:
A. Investigate any alleged violation of this chapter or rules adopted under this chapter and
investigate the direct or indirect ownership or control of any licensee; [PL 2003, c. 687, Pt. A,

B. Investigate the qualifications of each applicant before a license or registration is issued and
investigate the circumstances surrounding any act or transaction for which board approval is

C. Report to the board any alleged violations of this chapter or rules adopted under this chapter
and the results of any investigations of alleged violations of this chapter or rules adopted under this

D. Exchange fingerprint data with, and receive criminal history record information from, the
Federal Bureau of Investigation for use in considering an applicant for a license issued pursuant to

E. Report to the board the results of any investigation of an applicant for a license or registration
