1. Violation. A person, firm or corporation may not violate this subchapter or a rule adopted pursuant to this subchapter. [PL 2003, c. 452, Pt. B, §11 (NEW); PL 2003, c. 452, Pt. X, §2 (AFF).] 2. Penalty. The following penalties apply to violations of this section. A. A person who violates subsection 1 commits a civil violation for which a fine of not more than $500 may be adjudged. [PL 2007, c. 147, §7 (AMD).] B. A person who violates subsection 1 after having previously violated subsection 1 commits a civil violation for which a fine of not more than $1,000 may be adjudged. This subchapter may not be construed as requiring the commissioner or the commissioner's agent to report for suit or for the institution of seizure proceedings as a result of minor violations of this subchapter when the commissioner believes that the public interest will be best served by a suitable notice of warning in writing.
