Burden of proof to establish administrator's right to custody

Subject to subchapter 4 and section 2165, if the administrator asserts a right to custody of unclaimed
property and there is a dispute concerning the property, the administrator has the burden of proving:

1. Amount. The amount of the property;

2. Presumed abandoned. That the property is presumed abandoned; and

3. Custody of the administrator. That the property is subject to the custody of the administrator.
