Director's powers and duties

1. Regulation. The director shall administer, coordinate and enforce this chapter. The director
may appoint an advisory committee to assist the director on any matter that may arise under this chapter,
as needed.

2. Rule-making authority. The director shall establish guidelines and adopt rules necessary for
the proper administration and enforcement of this chapter. Rules adopted pursuant to this subsection
are routine technical rules as defined in Title 5, chapter 375, subchapter 2-A. The rules must address,
but are not limited to:
A. Requirements for the safe and proper construction, installation, alteration, repair, use, operation
and inspection of elevators and tramways in this State. The rules must include standards for the
review and audit of inspections performed by licensed private elevator inspectors not employed by
the State. The rules must conform as nearly as practicable to the established standards as approved
by the American National Standards Institute or its successor or other organization approved by the

B. Requirements for licensure and renewal of private elevator and lift inspectors, including
