1. System for appeals. The department shall establish a system for appeals in the case of a denial
of family leave benefits or medical leave benefits. In establishing the system, the department may use
any procedures or appeals mechanisms established under chapter 13.

2. Judicial review. Judicial review of any decision with respect to family leave benefits or medical
leave benefits must be permitted in a court of competent jurisdiction after a party aggrieved by the
decision has exhausted all administrative remedies established by the department.

3. Information related to appeals; confidentiality. The department shall implement procedures
to ensure confidentiality, to the maximum extent permitted by applicable laws, of all information related
to any claims filed or appeals made under this subchapter.
