Company liable for trespasses on adjoining land

The corporation is liable for trespasses and injuries to lands and buildings adjoining or in the
vicinity of its road committed by a person in its employment or occasioned by its order, if the party
injured within 60 days after the injured gives notice to the corporation; but its liability does not extend
to acts of willful and malicious trespass. The person committing a trespass is also liable. [PL 1987, c.
