Maine Code § 14-6802

Defendant ousting plaintiff deemed disseizor

If the person in possession has actually ousted the plaintiff or withheld the possession, he may, at
the plaintiff's election, be considered a disseizor for the purpose of trying the right, although he claims
an estate therein less than a freehold.
