Part owners receiving no share

When a person, not a party to the proceedings, to whom no share was assigned or left, claims to
have been a part owner of the estate, he is concluded so far as it respects the partition, but not from
maintaining an action against each person holding a share, for his proportion of each share as owned
before partition was made.
