Maine Code § 14-2854

Failure of executor or administrator to pay; plaintiff proceeds on motion

If the executor or administrator in the case last mentioned does not voluntarily pay the amount in
his hands, the plaintiff may proceed on motion as if the judgment in the first action had been against
him as trustee, but if he is discharged, he may recover costs or not at the discretion of the court.
