2-A. License eligibility. The commissioner may not issue a handfishing sea urchin license, a sea
urchin dragging license or a sea urchin hand-raking and trapping license to any person unless that
person:
A. Possessed that license in the previous calendar year; [PL 2007, c. 615, §18 (NEW).]
B. Becomes eligible to obtain that license pursuant to a limited entry system under subsection 2-B;

C. Did not possess a sea urchin license in the previous calendar year because the commissioner
had suspended the person’s license privileges for a length of time that included the previous

2-B. Sea urchin license limited entry system. The commissioner shall establish by rule a limited
entry system under which a person who did not hold a handfishing sea urchin license, a sea urchin
dragging license or a sea urchin hand-raking and trapping license in the previous calendar year may
become eligible to obtain that license for use in a zone established pursuant to section 6749-N. The
rules for a limited entry system must include provisions for the method and administration of the
program. Rules adopted pursuant to this subsection are routine technical rules as defined in Title 5,
chapter 375, subchapter II-A.

5. Protection from depletion. The commission may adopt rules for a sea urchin license limited
entry system to prohibit a new entry in a year when it is necessary to protect or conserve the urchin
fishery from imminent depletion.
