Commissioner's authority to regulate airmobiles

1. Rules. The commissioner shall adopt rules restricting the operation of airmobiles in areas where
their use may be harmful. These rules must be adopted in accordance with Title 5, chapter 375 after
public hearings in the areas affected. Rules adopted pursuant to this subsection are routine technical
rules as defined in Title 5, chapter 375, subchapter 2-A.

2. Minimum conditions. Rules adopted pursuant to subsection 1 must, at a minimum, establish
conditions for the use of airmobiles in fish and wildlife preserves, conservation areas, coastal and inland
wetlands and great ponds.

3. Prohibitions. The commissioner shall prohibit airmobile use wherever it adversely affects fish
and wildlife habitat, interferes with the operation of other watercraft, threatens public safety or
adversely affects the natural environment.
