"Person entitled to enforce" an instrument means: [PL 1993, c. 293, Pt. A, §2 (NEW).] (1). The holder of the instrument; [PL 1993, c. 293, Pt. A, §2 (NEW).] (2). A nonholder in possession of the instrument who has the rights of a holder; or [PL 1993, c. 293, Pt. A, §2 (NEW).] (3). A person not in possession of the instrument who is entitled to enforce the instrument pursuant to section 3-1309 or 3-1418, subsection (4). [PL 2011, c. 691, Pt. D, §3 (AMD).] A person may be a person entitled to enforce the instrument even though the person is not the owner of the instrument or is in wrongful possession of the instrument.
