A. A patient in an outpatient abortion facility shall be permitted unimpeded, private, and uncensored communications with persons by telephone. No outpatient abortion facility shall require a patient to forego possession of the patient's mobile phone or cellular phone as a condition for receiving services or patient access to the facility. B. A violation of this Section shall be considered a violation of a condition of licensure and shall be subject to the penalties provided for in R.S. 40:2199. C.(1) The provisions of this Section shall not be construed to provide a right to an abortion and are superseded by other provisions of law that restrict or prohibit abortion. (2) The provisions of this Section are intended to regulate the practice of abortion to provide for the health, safety, and welfare of women in outpatient abortion facilities until such time and to the extent that the state of Louisiana no longer regulates outpatient abortion facilities.
