A. A caregiver registry shall not participate in any of the following: (1) Employing, directing, or supervising caregivers. (2) Providing clinical oversight of caregivers. (3) Dictating any term or condition of a referred or matched caregiver's care relationship with an individual to whom the caregiver is referred or matched. B. A caregiver registry shall provide information regarding licensed healthcare providers and facilities through which the caregiver may need to operate to provide care giving services. C. A caregiver registry shall not constitute a home health agency as defined in R.S. 40:2116.31(B), a home- and community-based service provider as defined in R.S. 40:2120.2, or a nurse staffing agency as defined in R.S. 40:2120.13. D. A caregiver registry shall conduct a background check on the healthcare providers listed on the registry. E. A caregiver registry shall not refer, match, or place any caregiver to a licensed healthcare facility.
