Rules and regulations; standards

A. The department is hereby authorized and directed to promulgate and publish rules, regulations, and standards in accordance with the Administrative Procedure Act, to provide for the registration of certified nurse aides and to provide for the health, safety, and welfare of residents in nursing facilities. These rules, regulations, and standards shall have the effect of law. B. The department shall prescribe, promulgate, and publish rules, regulations and standards that may include the following: (1) Registration application and renewal registration procedures and requirements. (2) Minimum training requirements. (3) Complaint procedures and investigations. (4) Denial, revocation, suspension, non-renewal of registration, and procedures for appeal. (5) Unrestricted and restricted registration, and procedures for appeal. (6) Such other regulations or standards as deemed necessary by the department.
